These terms govern your use of VacoTours. Different sections apply depending on whether you are booking an experience, listing one, or reselling inventory through our API. This is a template published as part of the platform and should be reviewed by qualified counsel before it is relied upon commercially.
When you book an experience, your contract for that experience is with the operator who runs it. VacoTours acts as the booking and payment agent, and is responsible for taking your payment, issuing your voucher and passing your booking to the operator.
This distinction matters when something goes wrong on the day. The operator is responsible for delivering the experience as described; we are responsible for the transaction and for holding the operator to the terms they published.
A booking is not confirmed until you receive a confirmation and a voucher. Where a listing states instant confirmation, that happens the moment payment succeeds. Where it does not, the operator has a stated window in which to confirm or decline, and you are not charged if they decline.
Prices are held in US dollars and displayed in your chosen currency using rates refreshed hourly. The rate applied at the moment of booking is recorded on the booking and is the rate used for any refund.
Each experience publishes its own cancellation terms, shown on the listing before you book. Those terms are set by the operator and are the terms that apply to your booking, in the form they took at the moment you booked. If an operator changes their policy afterwards, your booking keeps the policy it was made under.
Where the operator cancels, you receive a full refund or the option to move to another date, with no fees of any kind.
Operators listing on the platform warrant that they operate the experience themselves, that they hold the licences and insurance their jurisdiction requires, and that the availability and terms they publish are accurate.
Trade buyers accessing inventory through the API agree not to sell below any published minimum selling price, to present cancellation terms accurately to their own customers, and to keep credentials confidential.
API credentials are issued per account. Sharing them with a third party, including a subsidiary or a technology vendor, requires written agreement.
Travellers pay at the time of booking. Trade buyers settle from a prefunded wallet or, where agreed, an approved credit line. Operators are paid on their agreed payout terms following travel.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our liability in connection with a booking is limited to the amount paid for that booking. The operator remains responsible for the delivery and safety of the experience itself.
We may update these terms. Material changes will be notified to account holders in advance, and the version in force when a booking is made continues to govern that booking.
